Terms of Service

These Terms of Service ("Terms") are an agreement between AirDesk ("AirDesk", "we", "us") and the business that creates an account ("you", the "Client"). By creating an account, connecting a phone line, or using the service, you agree to these Terms and to our Privacy Policy.

1. The service

AirDesk provides an AI-powered phone receptionist that answers calls forwarded to a dedicated number, converses with callers, books, reschedules and cancels appointments on a calendar you connect, sends text confirmations and reminders, transfers calls to a phone number you designate, and logs calls, recordings and transcripts in a web dashboard. Features may change as we improve the service.

2. Accounts

You must provide accurate business information and keep your login credentials confidential. You are responsible for everything done under your account and for the people you give access to. You must be at least 18 and authorized to bind the business.

3. Your responsibilities

  • Call recording notice. Calls are recorded and transcribed. You are responsible for any notice or consent required by the laws that apply to your business and your callers (for example, California requires all-party consent). On request we will add a recording notice to your greeting.
  • Text messaging. You authorize us to send confirmation and reminder texts to numbers callers provide, on your behalf, and to honor STOP/HELP requests. You will not ask us to send marketing texts through the service.
  • Emergencies. AirDesk is not an emergency service. When a caller reports gas, smoke, carbon monoxide or fire, the receptionist instructs them to leave and call 911 and attempts to transfer the call. You remain responsible for your own emergency response, on-call staffing and dispatch.
  • Accuracy of information. Hours, service area, policies, pricing guidance and transfer numbers come from you. The receptionist relies on them; keep them current.
  • Connected accounts. When you connect Google Calendar or Google Sheets you authorize AirDesk to act on your account as described in the Privacy Policy. You can disconnect at any time.
  • Acceptable use. No unlawful, deceptive or abusive use; no attempts to probe, disrupt or reverse-engineer the service; no use to harass callers or to collect information you are not entitled to collect.

4. AI limitations

The receptionist is an automated system. It can mishear, misunderstand or make mistakes, including booking errors. It does not give safety, legal, medical or engineering advice. You should review your dashboard regularly and correct anything that is wrong. We do not guarantee any particular call outcome, booking rate or revenue.

5. Fees and billing

Fees are stated at sign-up or in your order form and are billed monthly in advance. Usage beyond your plan (for example call minutes or text messages above the included amount) is billed at the rates shown in your plan. Fees are non-refundable except where required by law. We may change prices with at least 30 days' notice, effective at your next billing cycle. Overdue accounts may be suspended after notice.

6. Term and cancellation

The service continues month to month until cancelled. You may cancel from the dashboard or by emailing support@airdeskhq.com; cancellation takes effect at the end of the current billing period. On cancellation, forward your phone line elsewhere — calls to your AirDesk number will stop being answered. We may suspend or end service for breach of these Terms, non-payment, or risk to the platform, with notice where practical.

7. Data

You own your business data and your callers' data. You grant us the rights needed to operate the service (store, process, transmit, display it to you) and to create aggregated, de-identified statistics. Retention and deletion are described in the Privacy Policy. You are the business responsible to your callers for how their information is used; we act as your service provider.

8. Third-party services

The service depends on telephony, messaging, calendar, hosting and AI providers. Their outages or changes can affect the service, and their terms apply to your use of their features (for example Google's terms for a connected calendar). We are not responsible for third-party services we do not control.

9. Warranties and disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE OR ANSWER EVERY CALL.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, AIRDESK WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST JOBS OR MISSED CALLS, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE FEES YOU PAID US IN THE THREE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. Some jurisdictions do not allow certain limitations; in those places our liability is limited to the greatest extent permitted.

11. Indemnity

You will defend and indemnify AirDesk against claims arising from your business's services to its customers, your failure to provide required recording or messaging notices, information you supplied, or your violation of these Terms or applicable law.

12. Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Los Angeles County, California, and you consent to their jurisdiction. Either party may seek injunctive relief to protect its data or intellectual property.

13. Changes to these Terms

We may update these Terms. We will post the new version here with a new effective date and, for material changes, notify you in the dashboard or by email at least 14 days before they take effect. Continued use after that date is acceptance.
